MANILA, Philippines — Legal groups have called on senators to resolve the ongoing leadership dispute and refocus on their legislative responsibilities, including preparations for the impeachment trial of Vice President Sara Duterte.
The Integrated Bar of the Philippines (IBP) backed the validity of the June 3 Senate session that designated Senator Sherwin Gatchalian as acting Senate president and reorganized several committees. IBP National President Allan Panolong said the proceedings carry a presumption of legality.
A coalition of law deans and professors also defended the session, arguing that the Senate's effective membership has been reduced due to the unavailability of some senators. The group warned that allowing absent members to prevent legislative action could lead to a deadlock in the chamber.
The leadership dispute began after a split between the blocs of Senate President Alan Peter Cayetano and Gatchalian. The latter's camp secured a 12-member majority after Senator Francis Escudero joined its ranks, leading to a reorganization of Senate leadership.
Cayetano, however, argued that at least 13 senators are needed to constitute a quorum. He has described the leadership shake-up as an “illegal coup.”
Former Senate presidents Aquilino Pimentel III, Franklin Drilon, Juan Miguel Zubiri, and Vicente Sotto III appealed for restraint, urging lawmakers to settle their differences through proper parliamentary processes and address pressing national concerns.
Meanwhile, Senator Loren Legarda reiterated that the Supreme Court ruling in Avelino v. Cuenco cannot override the Constitution's requirement for a majority vote of all Senate members in electing or removing Senate officers.
The dispute has also reached the Supreme Court after a petition was filed seeking clarification on the legality of the June 3 session and the validity of the actions taken during the proceedings.
